Direitos fundamentais; família; justiça social; violência domésticaAbstract
The search for the realization of fundamental rights and the promotion of social justice has been a constant concern. The Maria da Penha Law represented a historic milestone in the fight against domestic and family violence, establishing protective measures and legal mechanisms to combat this type of crime. The recognition of the socio-affective pension reflects a broader and more inclusive conception of family, recognizing the bonds built through affection, coexistence and care. The objective of the work is to analyze how these two themes reflect a movement towards the humanization of Law, which seeks to protect the most vulnerable and guarantee equal rights for all. The methodology used involved a bibliographical review and analysis of jurisprudence related to the Maria da Penha Law and the recognition of the socio-affective pension, in order to understand its evolution and impact on society. The results obtained highlight the importance of the Maria da Penha Law in expanding the protection of victims of domestic and family violence, as well as the recognition of the socio-affective pension in promoting a more inclusive conception of family. The legal evolution represented by the Maria da Penha Law and the recognition of the socio-affective pension demonstrates the Law's ability to adapt to society's demands and promote social justice.
